University of Hertfordshire Research Archive Deposit Licence By agreeing to this licence, you (the author(s), copyright owner or assignee) grant a non-exclusive, royalty free, worldwide licence to the University of Hertfordshire on behalf of the UH Research Archive that warrant: Depositors Declaration 1.1 You are the owner of the copyright in the whole Work (including content & layout) or are duly authorised by the owner(s), or other holder of these rights and are competent to grant under this Licence Agreement, a licence to hold and disseminate copies of the Work. 1.2 a) The Work is original, and does not infringe any copyright, trademark, patent, intellectual property, or other rights of any person. That you have obtained all the third party consents, waivers and licences necessary for the use of the Work under this Licence Agreement. b) The work does not contain any material of an obscene or defamatory or racially offensive or sexually abusive nature. 1.3 That if the Work has been commissioned, sponsored or supported by any organization, you represent that you have fulfilled all of the obligations required by such contract or agreement. 1.4 You permit the Work to be accessed, printed and copied in an unaltered form with copyright acknowledged, on a temporary basis for personal study (which is not for a direct or indirect Commercial Use) and for any non Commercial Use. 1.5 Any content of the Work printed or copied by users may not be sold, licensed, transferred, further copied or reproduced in whole or in part, in any manner or in or on any media, to any person without your prior written consent. 1.6 You understand that depositing the Work in the UH Research Archive does not affect your rights to publish the work elsewhere, either in present or future versions. Repository’s rights and responsibilities 2. The UH Research Archive 2.1 May distribute copies of the Work (including the abstract) freely to the public, in electronic format via any medium for the lifetime of the Archive, by methods including but not limited to making the Work publicly available on the UH Research Archive web site. 2.2 May electronically store, translate, copy, or re-arrange the Work to ensure its future preservation and accessibility. UH Research Archive shall not be under any obligation to reproduce, transmit, broadcast, or display the Work in the same format or software as that in which it was originally created. 2.3 May incorporate metadata or documentation for the Work into public access catalogues. A citation to the Work will always remain visible. 2.4 Copyright in any additional data, software and documentation to assist users in using the Work shall belong to the UH Research Archive on behalf of the University of Hertfordshire and any other parties that the UH Research Archive may choose to enter into an agreement with to produce such materials. 2.5 Will make all reasonable efforts to represent the content of the Work faithfully. While every care will be taken to preserve the physical integrity of the e-print, the UH Research Archive shall incur no liability, either expressed or implicit, for the e-print or for the loss of or damage to any of the e-print or associated data. 2.6 Will not undertake to make the Works continuously available to the public nor to distribute the Work to any specific audience nor to distribute any specific number of copies of the Work. 2.7 Shall retain the right to remove the Work for professional or administrative reasons, or if it is found to violate the legal rights of any person. 2.8 Neither you nor UH Research Archive accept any liability whatsoever in contract, tort or otherwise for any loss or damage caused by, or arising directly or indirectly in connection with, any use made or reliance placed on the contents of the Work, except to the extent that such liability cannot be excluded by law. 2.9 Shall not be responsible for monitoring or enforcing or defending your rights in the Work or the rights of any third parties in the Work. 2.10 This Licence Agreement shall continue indefinitely unless terminated earlier for any reason. This Licence Agreement shall terminate immediately if: - UH Research Archive ceases to exist or its distribution services are withdrawn - You are in breach of your warranty in clause 2.1. This Licence Agreement shall terminate thirty days from Us receiving a written notice of termination from you or you receiving a written notice of termination from Us. The termination of this Licence Agreement shall not prevent Us from distributing existing copies of DVD or other recordings that include the Work in common with other works. 2.11 The Contracts (Rights of Third Parties) Act 1999 shall not apply to this Licence Agreement and nothing in this Licence Agreement shall confer or purport to confer on or operate to give any third party any benefit or any right to enforce any term of this Licence Agreement. 2.12 This Licence Agreement shall be governed by and construed in accordance with English law and you and We hereby irrevocably submit to the exclusive jurisdiction of the English Courts. Definitions 3 In this agreement 3.1 Licence Agreement: means this licence document including all of its terms and conditions. 3.2 Work: means the e-print being deposited including abstract, text, images and related data. 3.3 E-print: means an academic research paper or thesis stored in an electronic format. 3.4 Commercial Use: means use for the purpose of monetary reward by means of the sale, resale, loan, transfer, hire or other form of exploitation of the Licensed Work. 3.5 We, Us, Our, refers to the University of Hertfordshire Higher Education Corporation acting by the University or Hertfordshire Research Archive.
